# Terms of Service ("Terms")

**Effective Date:** October 8, 2025  

**Owner/Operator:** MageGamers ("MageGamers," "we," "us," or "our")

## 1) Acceptance of Terms

By accessing or using magegamers.com, our sub-pages, embeds, social integrations, Discord server, or any related services (collectively, the "Services"), you agree to these Terms. If you do not agree, do not use the Services.

 

## 2) Eligibility & Accounts

- You must be at least 13 years old (or older where local law requires). If you are under 18, you represent you have parental/guardian consent.  

- You are responsible for the accuracy of your account info, safeguarding your login credentials, and all activity under your account.

 

## 3) Community Guidelines

We’re a community for gamers and creators. You agree not to:

- Harass, threaten, dox, or defame others; post hate speech or illegal content.  

- Post or share malware, bots designed to inflate metrics, or tools to break a platform’s TOS.  

- Infringe IP rights or impersonate others.  

- Circumvent technical protections, rate limits, or access non-public areas of the Services.  

We may remove content, restrict features, or suspend/terminate accounts that violate these rules at our sole discretion.

 

## 4) User Content & License

You retain ownership of content you submit (text, images, links, comments, uploads, stream embeds, etc.). By submitting or linking content to the Services, you grant MageGamers a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute your content solely to operate, promote, and improve the Services. You represent you have all rights necessary to grant this license and that your content does not violate law or third-party rights.

 

## 5) Third-Party Services

Our Services integrate or link to third-party platforms—e.g., Twitch, YouTube, Discord, Google, X/Twitter, payment processors, giveaway providers, analytics, and hosting/automation tools (e.g., n8n, VPS). Those services are governed by their own terms and privacy policies. We are not responsible for third-party services.

 

## 6) Giveaways, Promotions, and Contests

From time to time, we may run promotions or giveaways (e.g., weekly/monthly gift cards). Each promotion will have Official Rules that govern eligibility, entry methods (e.g., chat activity), prize details, odds, and winner selection/verification. If there is a conflict between these Terms and the Official Rules, the Official Rules control for that promotion. Promotions are void where prohibited.

 

## 7) Purchases, Subscriptions, and Refunds

If we offer paid features, memberships, or digital goods, prices are shown at checkout and are subject to change. Taxes may apply. Unless stated otherwise, **all sales are final** for digital goods. Any trial or subscription will auto-renew until canceled as described at purchase. We may refuse or cancel orders at any time (e.g., suspected fraud).

 

## 8) Intellectual Property

All trademarks, logos, graphics, site design, and original content on the Services (excluding user content and third-party marks) are owned by MageGamers and protected by law. You may not copy, modify, or distribute our proprietary materials without our prior written consent. “MageGamers” and related marks are our trademarks or trade dress.

 

## 9) DMCA / Copyright Complaints

If you believe your copyright is infringed, send a notice that complies with 17 U.S.C. §512(c)(3) to our DMCA Agent at **shawshanker@magegamers.com**. Include: (a) your signature; (b) the work claimed infringed; (c) the infringing material and its location; (d) contact info; (e) a statement of good-faith belief; (f) a statement under penalty of perjury of accuracy and authority. We may remove content and, where appropriate, terminate repeat infringers.

 

## 10) Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

 

## 11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGEGAMERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.

 

## 12) Indemnification

You agree to defend, indemnify, and hold harmless MageGamers and our affiliates, officers, directors, employees, and agents from any claim, demand, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your content, your use of the Services, or your violation of these Terms or law.

 

## 13) Changes to the Services

We may modify, suspend, or discontinue any part of the Services at any time without notice. Features may change as platforms (e.g., Twitch/YouTube/Discord) change their APIs or policies.

 

## 14) Governing Law & Venue

These Terms are governed by the laws of the **United States** (and U.S. **DMCA** governs copyright takedown notices). You consent to the jurisdiction of courts within the United States as permitted by law.

 

## 15) Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination, the rights and obligations that by their nature should survive (e.g., Sections 4, 8–12, 14–16) will survive.

 

## 16) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the Effective Date. Your continued use of the Services after changes means you accept the updated Terms.
